Wellboy Terms of Use

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and Pankka Group Oy (business ID 3397011-8, Sukkulatie 10, 87700 Kajaani, Finland) (“Wellboy”, “we”). By installing or using the Wellboy app, you agree to these Terms. Our Privacy Policy (https://wellboy.app/privacy) describes how personal data is processed; it is provided for your information and is not part of this contract. If you do not agree to these Terms, do not use the app.

2. Eligibility

You must be at least 13 years old to use Wellboy, and at least the age at which you can consent to the processing of your personal data in your country if that age is higher (13 to 16 in the EU/EEA; 13 in Finland, 14 in Spain and Italy, 15 in France, 16 in Germany, Ireland and the Netherlands, for example).

The app enforces this minimum: it asks for your date of birth and does not accept a date that puts you below the minimum age that applies where you live. There is no parental-consent route. If you are below that age, you may not use Wellboy yet. You may use the app only in compliance with applicable law.

3. Health and safety disclaimer

Wellboy is a fitness and nutrition tracking tool, not a medical service.

  • Content in the app (workouts, exercise demonstrations, nutrition estimates, coach chat answers, generated plans) is for general informational purposes only. It is not medical, nutritional, or other professional advice.
  • Consult a physician before starting an exercise program, especially if you have a medical condition, are pregnant, or are new to training. Stop exercising immediately if you feel pain, dizziness, or discomfort.
  • You assume the inherent risks of physical exercise. Choose weights, movements, and intensities within your own ability.
  • AI outputs can be wrong. Calorie and macro estimates from photos, portion guesses, generated workouts, chat answers, and automatic repetition counting are estimates and may be inaccurate or incomplete. Never rely on them for allergy, medication, or other medical decisions, and verify nutrition information from product packaging where accuracy matters.

4. Accounts

  • Wellboy starts you with an automatically created anonymous account and asks you to register a sign-in method (Sign in with Apple, Google Sign-In, or email and password) at the end of onboarding. Registering links your existing data to that sign-in so it follows you across devices.
  • Data on an unregistered (anonymous) account cannot be recovered after signing out or losing the device.
  • Keep your credentials and device secure; you are responsible for activity under your account. One account is for one person.
  • Signing in with a different account replaces the data on the device (the app warns you before this happens).

5. Virtual credits

  • Wellboy uses virtual credits that are earned in the app (for example the daily collect, level rewards, streak bonuses, and friend rewards) and spent on features such as AI actions, share codes, and adding barcode-scanned products to your food log on the free plan.
  • If you have Wellboy Pro (section 6), app features do not charge credits.
  • Credits are not money: they have no cash value, cannot be transferred, sold, or redeemed, and are lost when your account is deleted.
  • Credits cannot be bought. They are earned in the app only. Wellboy does not sell credits for real money and does not include them in any paid plan.
  • We may change credit prices, daily grants, caps, and earning rules, and may adjust balances in cases of error or abuse.
  • Refunds: credits spent on a completed action (for example a successful AI generation) are not refunded, except where required by law. Failed AI actions and failed share creations are not charged: a charge for such an action that fails is reversed automatically. The credit charge for adding a barcode-scanned product on the free plan is confirmed at the moment of the add and has no automatic reversal; if you believe you were charged for an add you did not receive, contact support.

6. Wellboy Pro (paid membership)

6.1 What Pro is

Wellboy Pro is an optional paid membership. Pro removes credit charges from app features, unlocks the full exercise library, removes the free plan’s day and month limits on AI features and food lookups (subject to the fair-use limits in section 7), unlocks premium analytics and full history, and allows multiple active training programs. The exact feature set is shown in the app and may evolve over time (section 13).

6.2 Purchases are made through the app stores

Pro is bought inside the app through Apple’s App Store or Google Play. The store processes the payment under its own terms; we never receive your card details. Prices, taxes, and local currency are shown in the store’s checkout.

6.3 Subscriptions (weekly, and annual when offered)

  • The weekly subscription renews automatically every week until you cancel it. Where you are eligible, an introductory price applies to the first 12 weeks (billed weekly, pay as you go), after which the standard weekly price applies. Introductory-price eligibility is determined by the store (typically once per store account); if you are not eligible, the app shows the standard price before you buy.
  • An annual subscription, when offered, renews automatically every year.
  • Cancel any time in your store’s subscription settings (App Store: Settings > your Apple account > Subscriptions; Google Play: Play Store > Payments and subscriptions). Deleting the app or your Wellboy account does not cancel a subscription by itself.
  • Cancellation stops future renewals; Pro stays active until the end of the period you already paid for. Fees already paid are not refunded by us, except where mandatory law gives you a right to a refund or other remedy; the store’s own refund policies, and any refunds the store grants, are separate and unaffected.
  • Upgrading from weekly to annual takes effect according to the store’s rules.

6.4 Lifetime purchase

  • The lifetime purchase is a one-time payment that grants Pro permanently, for as long as the Wellboy service is offered, with no recurring billing.

  • Lifetime access is sold in numbered price tiers per store currency, each with a target allocation of purchases at that price. The app shows an indicative remaining count for the current tier. When a tier’s allocation runs out, purchases continue at the old price for a fixed final window of 60 minutes (during which the allocation can be exceeded), after which the next tier’s higher price applies. Once the final tier’s allocation runs out and its final window ends, the lifetime purchase is retired and no longer offered.

6.5 Holding both a subscription and lifetime

Buying the lifetime purchase while a weekly subscription is active does not automatically end the subscription on the App Store: cancel it yourself in your Apple subscription settings (the app reminds you and links there). On Google Play we attempt to cancel the subscription’s future renewals on your behalf where technically possible; this attempt can fail, so check your Play subscription settings and cancel the subscription yourself unless Google Play confirms the cancellation to you. Time already paid on the subscription is not refunded by us (see 6.3).

6.6 Creator codes

A valid creator code entered on the paywall unlocks discounted lifetime prices. Codes are personal to their creators, may be deactivated or expire, and a discounted purchase consumes the same limited batch as a regular purchase. Codes have no cash value.

6.7 Restoring purchases and account transfer

Your Pro membership is tied to your Wellboy account and backed by the store purchase. Use Restore purchases on the paywall if Pro does not show up after a reinstall or a new device. If the same store purchase is restored while you are signed in to a different Wellboy account, the membership transfers to the account that restored it (memberships follow the store receipt; they are not duplicated across Wellboy accounts).

6.8 EU/EEA right of withdrawal

If you are a consumer in the EU/EEA, you generally have a 14-day right of withdrawal for purchases of digital content and services. Wellboy Pro (including the lifetime purchase, which is a one-time payment for an ongoing service) is a digital service. When you start your Pro membership, you request immediate performance; the store’s checkout presents the consents and acknowledgements the law requires and handles withdrawal and refund requests. Withdrawal and refund requests are made to the store you bought from (Apple or Google).

6.9 Price changes

We may change subscription prices for future billing periods. The store notifies you in advance and, where the law or the store requires it, asks for your consent before a renewal at a higher price; otherwise you can cancel before the change takes effect. Lifetime tier prices change only through the batch ladder in 6.4.

7. AI features and fair use

  • AI features (meal photo scan, coach chat, workout generation) are powered by OpenAI and run through Wellboy’s servers. Your inputs are processed as described in the Privacy Policy.

  • AI outputs are generated automatically and may be inaccurate, incomplete, or unsuitable for your situation. You are responsible for reviewing outputs before relying on them (see section 3).

  • Do not use AI features to attempt to generate unlawful, harmful, or infringing content, or to extract other people’s personal data.

  • Free plan: AI actions cost credits and are limited per day and per calendar month. The app shows the remaining uses.

  • Pro plan and the meaning of “unlimited”: Pro AI use is unlimited in the sense that Pro never pays credits: no credits are charged, and use is subject only to the fair-use caps below. To keep the service available to everyone and to prevent automated abuse, the following fair-use caps apply per account:

    Barcode and text food lookups are not capped on Pro. A “day” is the app’s logical day: it rolls over at 03:30 in the time zone stored on your account (your device’s most recently reported time zone; Europe/Helsinki is used if none is stored). We may adjust these caps to protect the service; the current caps are listed here, and material reductions are announced before they take effect.

8. Your content

  • You keep ownership of the content you add (meals, recipes, photos, workouts, measurements, messages).
  • You grant Wellboy a non-exclusive, worldwide license to host, store, process, transmit, and display your content as needed to operate the service, including displaying content you explicitly share via share codes to anyone who has the code.
  • You are responsible for having the necessary rights to the content you add (for example photos), and for not adding content that is unlawful, infringing, or harmful.
  • We may remove content or revoke share codes that violate these Terms or the law.

9. Share codes

  • Creating a share code publishes a frozen public snapshot of the shared content. Anyone with the code can view and import it. The snapshot does not update when you edit the original.
  • You can deactivate your codes in Settings > My share codes.
  • Deleting your account also permanently deletes your published share snapshots. Content that other users already imported from your codes stays in their accounts.

10. Acceptable use

You agree not to:

  • interfere with or circumvent security features (including device attestation), rate limits, usage caps, or credit rules,
  • cheat or manipulate challenges, streaks, XP, credits, purchases, pricing counters, or creator codes,
  • access the service by automated means, scrape it, or bulk-download content,
  • reverse engineer the app except to the extent such a restriction is prohibited by applicable law,
  • resell or commercially exploit the service or its content without our written permission,
  • use the service to harass others or to violate anyone’s rights.

11. Third-party services

The app relies on third-party services: Apple and Google sign-in and billing, Google Firebase, OpenAI, RevenueCat (purchase management), Open Food Facts and USDA FoodData Central (product data), and content delivery networks. Their terms and privacy policies apply to their processing. We are not responsible for third-party services or for content in third-party databases (for example product data from Open Food Facts may be inaccurate).

12. Intellectual property

The app, its design, brand, exercise library, coach characters, demonstration videos, and other content (excluding your content) belong to Wellboy or its licensors. We grant you a limited, personal, non-transferable, revocable license to use the app for your own non-commercial fitness purposes.

13. Availability and changes to the service

Core tracking works offline; syncing and online features require connectivity and the availability of our service providers. We may add, change, or discontinue features, and may suspend or limit accounts that violate these Terms. We will aim to give reasonable notice of material changes where practicable.

14. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. EU CONSUMERS RETAIN THEIR STATUTORY RIGHTS.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELLBOY IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

16. Indemnity

You will indemnify Wellboy against third-party claims arising from your content or your breach of these Terms, to the extent permitted by applicable law.

17. Termination

  • You can stop using the app at any time and delete your account in Settings > Account (see the Privacy Policy for what deletion covers).
  • We may suspend or terminate accounts that violate these Terms or where required by law.
  • Sections that by their nature should survive (8, 12, 14 to 16, 18) survive termination.

18. Governing law and disputes

These Terms are governed by the laws of Finland, excluding its conflict-of-law rules. If you are a consumer in the EU/EEA, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of your country of residence, and you may bring proceedings in the courts of your home country. Consumers in Finland may also contact the Consumer Disputes Board (kuluttajariita.fi). The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

19. Changes to these Terms

We may update these Terms. We will post updates at https://wellboy.app/terms and give notice in the app of material changes before they take effect. Continued use after the effective date constitutes acceptance.

20. Language

These Terms are drawn up in English, which is the binding version. Translations may be provided for convenience; if a translation conflicts with the English version, the English version prevails.
